Woman in court over fly-tipped waste

 

A DRYSLWYN woman has been ordered to pay over £600 after failing to check that the person she paid to take waste from her home was properly licensed.

Hannah Kay Disley, of Llys Carys, pleaded guilty at Llanelli Magistrates Court to an offence under Section 34 of the Environmental Protection Act.

The prosecution was brought by Carmarthenshire County Council.

The court heard that in October last year, council enforcement officers were responding to a complaint of fly-tipping on a patch of land near a minor road leading from Llanfynydd to Abergorlech.

There they found a large pile of waste including blue recycling bags which contained general household waste, a garden strimmer, a wicker chair and a bed base.

They also found documents addressed to Miss Disley, which led to them calling at her home.

Under caution she stated that she had been in contact with someone unknown to her via Facebook and as a result a male driving a grey van turned up at her property to remove the waste.

Later, during a formal taped interview, she told officers that what she’d said previously was untrue, and that two men she didn’t know, driving a large dark coloured van, had knocked at her door late in the evening asking if she had anything to take away and had paid them £5 to take some refuse bags of household waste away.

She didn’t ask them if they were registered waste carriers, stating in court that she hadn’t done so because she felt intimidated.

She admitted that the bags of waste found near Llanfynydd were hers, but denied knowledge of the other fly-tipped items.

Magistrates fined her £120, and ordered her to pay costs of £466.15 and a £30 victim surcharge.

Anyone who pays someone to dispose of waste on their behalf is responsible in law for carrying out the necessary checks to ensure the person has a valid waste carriers licence.

Cllr Philip Hughes, executive board member for environmental enforcement, said: “As this case demonstrates, quite often there are people out there happy to take your money and then fly-tip your rubbish. Unfortunately, this has repercussions not only on the environment but on the person who was getting rid of that waste. It’s vitally important to make the necessary checks.”

MAE menyw o Ddryslwyn wedi cael gorchymyn i dalu dros £600 am fethu â gwirio bod trwydded briodol gan y person yr oedd wedi’i dalu am waredu’i gwastraff.

Plediodd Hannah Kay Disley, o Lys Carys, yn euog yn Llys Ynadon Llanelli i drosedd o dan Adran 34 o Ddeddf Diogelu’r Amgylchedd.

Cafodd yr achos ei ddwyn gan Gyngor Sir Caerfyrddin.

Clywodd y llys fod swyddogion gorfodi’r Cyngor yn ymateb i gŵyn am dipio anghyfreithlon ar ddarn o dir ger isffordd rhwng Llanfynydd ac Abergorlech ym mis Hydref y llynedd.

Yno, daethant o hyd i domen fawr o wastraff gan gynnwys bagiau ailgylchu glas a oedd yn cynnwys gwastraff cartref cyffredinol, strimiwr gardd, cadair gwiail a sylfaen gwely.

Yn ogystal daethant o hyd i ddogfennau wedi’u cyfeirio at Miss Disley felly aethant i’w chartref.

Ar ôl iddi gael rhybudd, dywedodd ei bod wedi cysylltu â rhywun dieithr ar Facebook ac o ganlyniad daeth dyn mewn fan llwyd i’w chartref i waredu’r gwastraff.

Yn hwyrach, yn ystod cyfweliad ffurfiol wedi’i dapio, dywedodd wrth swyddogion fod yr hyn a ddywedodd yn flaenorol yn anwir a bod dau ddyn dieithr mewn fan fawr dywyll o ran lliw wedi cnocio ar ei drws yn hwyr un noson yn gofyn a oedd ganddi bethau i’w gwaredu.  Talodd y fenyw £5 i’r dynion am fynd ag ychydig o fagiau sbwriel yn cynnwys gwastraff y cartref.

Ni ofynnodd iddynt a oeddent yn gludwyr gwastraff cofrestredig a nododd yn y llys ei bod heb wneud hyn oherwydd ei bod yn teimlo dan fygythiad.

Cyfaddefodd mai hi oedd â’r bagiau gwastraff y daethpwyd o hyd iddynt ger Llanfynydd ond gwadodd unrhyw wybodaeth am yr eitemau eraill a dipiwyd yn anghyfreithlon.

Cafodd ddirwy o £120 gan Lys Ynadon a gorchmynnwyd iddi dalu costau o £466.15 a gordal dioddefwr o £30.

Mae pobl sy’n talu eraill am waredu gwastraff ar eu rhan yn gyfrifol yn ôl y gyfraith am gynnal y gwiriadau angenrheidiol er mwyn sicrhau bod gan y person drwydded cludo gwastraff ddilys.

Dywedodd y Cynghorydd Philip Hughes, yr Aelod o Fwrdd Gweithredol y Sir dros Orfodi Materion Amgylcheddol: “Fel mae’r achos hwn yn dangos, yn aml, mae pobl yn hapus i gymryd eich arian ac yna tipio’ch gwastraff yn anghyfreithlon. Yn anffodus, mae gan weithredoedd fel hyn ganlyniadau, nid yn unig ar yr amgylchedd ond hefyd y person a oedd yn gwaredu’r gwastraff yn y lle cyntaf. Mae’n hanfodol bwysig gwneud y gwiriadau angenrheidiol.”
