A Llanelli business has been fined £100 for failing to have proper arrangements in place for the disposal of its waste.
The owner was issued with a fixed penalty notice by council environmental enforcement officers.
All businesses must have an agreement in place with a fully licensed waste company to make sure that any waste produced during the course of their business, is stored, transported and disposed of without harming the environment; known as their ‘Duty of Care.’
Officers had issued a Section 47 notice under the Environmental Protection Act 1990 giving the owner 21 days to make the necessary arrangements for the correct disposal of his waste. However, he failed to do and was fined for being in breach of the notice.
Executive Board Member for Environmental and Public Protection Cllr Jim Jones said: “All businesses have a responsibility to ensure reasonable measures are taken to dispose of their waste.
“Duty of Care is one of the main ways to combat fly-tipping and businesses that fail to comply with this legislation can be prosecuted.
“The majority of businesses in Carmarthenshire are fully aware and compliant but it is important that we remind people of the legislation.”
Failure to comply could lead to prosecution in the magistrates court and a maximum fine of up to £5,000 or more if at crown court.
