EU Directive 2004/38/EC – Free Movement Rights of EU Citizens:
Implemented in the UK by the immigration (European Economic Area) Regulations 2006 Directive 2004/38 deals primarily with rights of entry and residence of the EU citizen and family members, the Directive applies to all individuals holding nationality of an EU Member State and covers workers’ rights as well. Article 5 outlines EU citizen’s rights of entry into other EU Member States. In theory EU citizens only have to present a valid passport or ID card although their rights of residency under Article 6 only extend to three months unless per-Article 7 they are employed or self-employed, have sufficient resources for themselves and their family, or are studying or are a family member accompanying a Union Citizen who satisfies these conditions.
It should be noted by our authorities that the vast amount of Bulgarian/Romanian and other Country’s nationalities begging on the streets of all our major cities do not fit into this category and therefore can be deported legally.
