An appeal against a refusal by Pembrokeshire County Council to grant a certificate of lawful use or development (LDC) for a property in Blaenffos has been dismissed by the Planning Inspectorate.
The appeal was made by Redkite Law LLP and the beneficiaries of the Francis Estate in respect of a dwelling known as Rhyd Ddu.
The LDC was sought on the basis of non-compliance with an agricultural occupancy condition for a ten year-plus continuous period.
Inspector Mr Declan Beggan said the issue between the parties was whether a breach of the condition existed at the time the LDC application was made in November 2015.
In his conclusion, he said on the balance of probability there had not been a continuous breach of the agricultural occupancy condition over the 10 years preceding the date of the LDC application.
The Inspector also rejected an application by Redkite Law LLP and the beneficiaries of the Francis Estate for a full award of costs against Pembrokeshire County Council.
