Council gets tough on fly-tipping with bigger fines

 

PEOPLE caught dumping rubbish now face even tougher fines than before.

Council enforcement officers now have additional powers and can serve people with a fixed penalty notice of up to £350 on anyone caught fly tipping even small amounts of waste.

In 2015/16 over 36,000 fly-tipping incidents were recorded in Wales, costing the Welsh taxpayer more than £2million to clear up.

Cllr Philip Hughes, executive board member for enforcement, said: “Of course we would prefer that we didn’t have to issue fines and people had respect for their environment by properly disposing of their waste. But, when people have complete disregard for their environment, communities and fellow residents, we will not hesitate to issue fixed penalty notices.

“The fact that we now have additional powers and can impose even more expensive fines, we hope that people will think twice before fly-tipping.

“We have four recycling centres in the county, and over 150 recycling banks, we also have a kerbside collection and can arrange to collect bulky items from households – there really isn’t any excuse to dump rubbish and expect someone else to clear it up.”

Householders, landlords and business owners are responsible and legally obliged to manage waste from their property safely and appropriately.

Whether people leave waste at the side of a litter bin, on the ground in a recycling centre or dump down a country lane, each case is classed as fly tipping and therefore a crime.

Anyone who pays for someone to take waste away is also legally responsible for ensuring the person is properly licensed – otherwise, if the rubbish is found dumped and traced back to their household or business, they too will face a fine.

    MAE pobl sy’n cael eu dal yn gwaredu sbwriel bellach yn cael dirwyon mwy fyth nag o’r blaen.

    Mae pwerau ychwanegol gan swyddogion gorfodi y Cyngor erbyn hyn ac maen nhw’n gallu rhoi hysbysiad cosb benodedig o hyd at £350 i unrhyw un sy’n cael ei ddal yn tipio hyd yn oed ychydig bach o sbwriel yn anghyfreithlon.

    Yn 2015/16 cafodd dros 36,000 o achosion o dipio anghyfreithlon eu cofnodi yng Nghymru, a chostiodd hyn fwy na £2 filiwn o arian trethdalwyr yng Nghymru i glirio’r sbwriel.

    Dywedodd y Cynghorydd Philip Hughes, yr Aelod o’r Bwrdd Gweithredol dros Faterion Gorfodi: “Wrth gwrs, byddai’n well gennym pe na byddai’n rhaid inni roi dirwyon a phetai gan bobl fwy o barch tuag at eu hamgylchedd drwy gael gwared ar eu gwastraff yn y modd cywir. Ond pan fydd pobl yn diystyru eu hamgylchedd, eu cymunedau a’u cyd-breswylwyr yn llwyr, ni fyddwn yn oedi cyn rhoi hysbysiadau cosb benodedig iddyn nhw.

    “Gan fod gennym bwerau ychwanegol bellach a’n bod yn gallu rhoi dirwyon drytach fyth, rydym yn gobeithio y bydd pobl yn ailfeddwl cyn tipio’n anghyfreithlon.

    “Mae gennym bedair canolfan ailgylchu yn y Sir, a dros 150 o fanciau ailgylchu. Hefyd mae gennym wasanaeth casglu o dŷ i dŷ a gallwn drefnu casglu eitemau mawr o aelwydydd, felly does dim esgus dros waredu gwastraff a disgwyl i rywun arall ei glirio.”

    Mae preswylwyr, landlordiaid a pherchnogion busnesau yn gyfrifol am reoli gwastraff o’u heiddo yn ddiogel ac yn briodol, ac mae rhwymedigaeth gyfreithiol arnyn nhw i wneud hynny.

    Boed yn gadael gwastraff wrth ochr bin sbwriel, ar y tir mewn canolfan ailgylchu neu mewn lôn dawel yn y wlad, mae pob achos yn cael ei ystyried yn dipio anghyfreithlon ac felly yn drosedd.

    Mae unrhyw un sy’n talu rhywun i gludo gwastraff hefyd yn gyfreithiol gyfrifol am sicrhau bod y person wedi’i drwyddedu’n gywir. Fel arall, os bydd y sbwriel hwn yn cael ei ganfod wedi’i daflu yn rhywle ac yn cael ei olrhain i aelwyd neu i fusnes yr unigolyn, bydd ef hefyd yn wynebu dirwy.
