I do not accept _“”your most sincere apologies (on __11/04/2018) __for the delay in acknowledging receipt of my correspondence dated 23rd March 2018 due to your annual leave and other work commitments.””_

 

You seem to have forgotten that you have used this excuse before.  My correspondence of 23rd March 2018 was also sent to Alun Williams, Ceredigion Councillor for Transport, in addition to the Ceredigion

Freedom of Information office,  ie not just to you.    On 28th  March

2018 I sent a reminder that I had not received an acknowledgement to both Alun Williams and Gerwyn Jones (Technical Services) in addition to

the Ceredigion Freedom of Information office .   I do not accept your

statement that _“”__ you will receive a response as soon as

possible.””._     I therefore require that you to consider that the

date of receipt of my correspondence was 26th March 2018 and not 11/04/2018,  since the 16 day delay to acknowledge my correspondence is

due to Ceredigion County Council’s  incompetence.   The FOIA quotes

_“”__The date of receipt will be the day on which the request is physically or electronically delivered to the authority,or directly into the email inbox of a member of staff””_

 

I also request that you do not use your usual technique of taking 20 working days to reply.  I request that you  reply promptly using a

receipt date of 26th March 2018.   The FOIA quotes _“”__The

obligation to respond promptly means that an authority should comply with a request as soon as is reasonably practicable.  Authorities should regard the 20 working day limit as a ‘long stop’, in other words the latest possible date on which they may issue a response.  It also follows that an authority which provides its response close to, or on, the final day of the 20 working day limit ought to be able to both account for, and justify, the length of time taken to comply with the request””_

 

I do not accept your view that _“”some elements of my correspondence should be considered under Freedom of Information legislation and others in accordance with Ceredigion County Council’s Customer Charter as these are considered to be enquiries rather than requests for

information.””_    In my correspondence dated 23rd March 2018 I

expressed dissatisfaction with the responses from Gerwyn Jones received

on 21/03/2018 to my Freedom of Information Request of 24/02/2018.   The

expression of dissatisfaction with the responses to a Freedom of Information Request are considered by the Information Commissioner as a

request for an internal review.    You can therefore treat my expression

of dissatisfaction as a request for an internal review and answer my requests for further information under the Freedom of Information Act.

There is no element of my correspondence of 23rd March 2018 that is an enquiry in accordance with Ceredigion County Council’s Customer

Charter.   The correspondence is titled “”Ceredigion Council FOI

Trawscymru T2 timetable changes of 15/01/2018 and a T3 route to Aberystwyth instead of Barmouth (781192)”” and solely relates to the subject of my request of 24/02/2018 and Ceredigion County Council’s reply of 21/03/2018. There is no element that can be even remotely considered as a customer enquiry.

 

Could you therefore please urgently acknowledge receipt of this email and state (1) that you accept the receipt date of my correspondence as 26th March 2018 (2)  quote the date you intend to respond by (3) Specify in detail which questions in my correspondence you will be treating as a request for an internal review and which questions you will treat as a Freedom of Information request.  Should I not receive the above information urgently I shall forward this email as a complaint to the Information Commissioner.
